Participants (and their parents or legal guardians, if applicable) assume all risks of participating in the Activities and using the Equipment, even those caused by the negligent acts or conduct of the instructor and kiteboardinginstructors.com, its owners, affiliates, operators, employees, agents, officers, and/or any entity to which the directory owes a contractual indemnification obligation. kiteboardinginstructors.com does not assume any responsibility or liability for accidents, injuries, damages, or any other losses that may occur during or as a result of lessons found through our platform.
Responsibility of Instructors: Instructors listed on our platform are independent contractors responsible for providing lessons to Students. kiteboardinginstructors.com does not employ Instructors and is not responsible for the actions, conduct, or negligence of Instructors. Students acknowledge that their contractual relationship is solely with the Instructor, and any issues, disputes, or claims related to the lessons must be resolved directly with the Instructor.
Booking and Payment: Students must contact and book lessons directly with Instructors. Payments, refunds, and any other financial transactions are handled directly between Students and Instructors. kiteboardinginstructors.com is not a party to any transactions and is not responsible for any disputes regarding bookings, payments, or refunds.
User Conduct: Users of our platform, including Students and Instructors, must conduct themselves in a respectful and lawful manner. Any abusive, fraudulent, or illegal behavior will result in immediate termination of access to our platform.
Intellectual Property: All content on our website and directory platform, including but not limited to text, images, logos, and software, is the property of kiteboardinginstructors.com and protected by intellectual property laws. Release of Liability, Assumption of Risk, and Indemnification
By accessing or using the services provided by kiteboardinginstructors.com, including but not limited to finding kiteboarding, kite foiling, surfing, and wing foiling lessons (referred to as “Activities”) through our directory platform, you agree to the following terms:
Waiver of Claims: You waive all claims against kiteboardinginstructors.com arising out of your participation in the Activities or the use of any equipment provided by the instructors listed on our platform, including while receiving instruction and/or training.
Assumption of Risk: You assume all risks of participating in the Activities and using the equipment, even those caused by the negligent acts or conduct of the Hosts, their owners, affiliates, operators, employees, agents, officers, and/or any entity to which the Hosts owe a contractual indemnification obligation. You understand that there are inherent risks associated with participating in the Activities and using the Equipment, which may result in serious physical injury or death.
Release of Liability: You release kiteboardinginstructors.com, its owners, affiliates, operators, employees, agents, officers, and/or any entity to which kiteboardinginstructors.com owes a contractual indemnification obligation, from all liability for any loss, damage, injury, death, or expense that you may suffer, arising out of your participation in the Activities and/or use of the Equipment.
Indemnification: You agree to indemnify kiteboardinginstructors.com, its owners, affiliates, operators, employees, agents, officers, and/or any entity to which kiteboardinginstructors.com owes a contractual indemnification obligation, from all liability for any loss, damage, injury, death, or expense that you may suffer, arising out of participation in the Activities and/or use of the Equipment.
Personal Responsibility: You certify that you have no physical or mental condition that precludes you from participating in the Activities and that you are not participating against medical advice. You understand that your participation in the Activities is voluntary and that you are obligated to follow the rules of the Activities to minimize the risk of injury. If you observe any unusual hazard or condition while participating in the Activities, you will remove yourself from participation and bring said hazard or condition to the attention of the Host.
Severability: If any portion of these terms is deemed to be invalid under applicable law, the remaining portions shall remain binding.

General Refund Policy
Refund and Rescheduling Policy for Kiteboarding, Kite Foiling, Wing Foiling, Windsurfing, Surfing, and Skateboarding Lessons
At kiteboardinginstructors.com, we partner with top instructors and schools to offer you a wide range of action sports lessons, including kiteboarding, kite foiling, wing foiling, surfing, and skateboarding. We understand that weather conditions and unforeseen circumstances can affect lesson schedules. Our refund and rescheduling policy ensures a fair and flexible approach, guaranteeing you receive the full value of your lesson booking.
General Policy
Full Refund or Reschedule for Cancellations:
- If a lesson is canceled due to unsuitable weather conditions (e.g., lack of wind, excessive wind, rain) or other unforeseen circumstances, you will have the option to reschedule to another day or receive a full refund.
Pro-Rated Refunds or Reschedules for Interrupted Lessons:
- If a lesson starts but must be cut short due to changing weather conditions or other reasons, the remaining part of the lesson will be added to your next scheduled lesson. If no further lessons are scheduled, a pro-rated refund will be issued for the remaining portion.
- There will be no refund if the class is held and only cut short by 15 minutes or less.
No-Show or Late Show-Up Rules:
- Student No-Show: If a student does not show up for a scheduled lesson, the lesson will be considered completed and no refund will be issued.
- Student Late Arrival: If a student arrives late, there will be no pro-rated credit for the missed time.
- Instructor No-Show: If an instructor does not show up for a scheduled lesson, the student will receive a full refund.
- Instructor Late Arrival: If an instructor arrives late and the student cannot complete the full lesson, the student will receive a pro-rated credit for the next lesson or a refund for the missed portion.
- Arrival Recommendation: We suggest both instructors and students arrive at the scheduled lesson time a minimum of 15-20 minutes early to account for parking, applying sunscreen, and generally getting acclimated.
- Parking Responsibility: Students are responsible for their own parking and must obey local laws and rules. Being late or a no-show because of parking issues does not grant the student any credit or refund.
Specific Conditions
Kiteboarding, Kite Foiling, Wing Foiling, Windsurfing:
- No Wind or Excessive Wind: If conditions are unsuitable for kiteboarding, kite foiling, or wing foiling, you may reschedule your lesson or receive a full refund.
- Interrupted Sessions: If your session is interrupted by changing wind conditions, the remaining portion will be added to your next lesson or refunded if no further lessons are scheduled.
Surfing:
- High Surf Advisories or Poor Water Conditions: If a surfing lesson is canceled due to high surf advisories or poor water conditions, you may reschedule your lesson or receive a full refund.
- Interrupted Sessions: If your surfing lesson is cut short, the remaining portion will be added to your next lesson or refunded if no further lessons are scheduled.
Skateboarding, Onewheel riding:
- Rain or Unsafe Conditions: If a skateboarding lesson is canceled due to rain or unsafe conditions, you may reschedule your lesson or receive a full refund.
- Interrupted Sessions: If your skateboarding lesson is cut short, the remaining portion will be added to your next lesson or refunded if no further lessons are scheduled.
Additional Information
Advance Notice:
- We aim to provide notice of cancellations due to weather or other conditions as soon as possible, typically the day before or the morning of the lesson.
Weather Guarantee:
- We offer a weather guarantee to ensure you get the full experience. If conditions are not suitable, you can reschedule your lesson at no additional cost until the conditions are right.
